If you receive government subsidy under a voucher program such as Housing Choice Voucher (HCV), landlords cannot:
• Deny you housing for a unit based solely on your ability to pay the entire rent since a portion of the rent is being paid by the voucher program. Instead, landlords are only allowed to assess your ability to pay your portion of the rent. California Fair Employment and Housing Act (FEHA); AND
• Deny you housing for a unit based solely on your credit history without offering you the option to provide lawful, verifiable alternative evidence that you can reasonably pay your portion of the rent (tenant portion). Evidence includes, but is not limited to, government benefit payments, pay records, and bank statements. If you choose to provide this evidence, the landlord must give you reasonable time to provide documentation and must reasonably consider the evidence in lieu of your credit history in determining whether to offer the unit to you.
